1. Agreement to Terms

Welcome to Feeq. These Terms and Conditions (“Terms”) govern your use of our website located at https://feeq.ae/ (the “Site”) and your purchase of products (“Products”) and services (“Services”) from us.

By accessing our Site, creating an account, or purchasing Products or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Site or services.

2. User Accounts

To access certain features of the Site, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Product Information and Pricing

We strive to ensure that all details, descriptions, and prices of Products appearing on the Site are accurate. However, errors may occur. If we discover an error in the price of any Products you have ordered, we will inform you of this as soon as possible. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

5. Orders and Payment

  • Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.
  • Payment: All payments must be made at the time of order placement. We accept various payment methods as indicated on the Site. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

6. Shipping and Delivery

We will arrange for the shipment of the Products to you. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Risk of loss and title for all Products ordered pass to you upon our delivery to the shipping carrier.

7. Returns and Refunds

All sales of Products are governed by our Return & Refund Policy. Please review this policy carefully. By purchasing Products from us, you agree to the terms of our Return & Refund Policy, which is incorporated by reference into these Terms.

Part B: Terms for Feeq Tech Solutions (IT Services)

8. Services, Proposals, and Agreements

  • Scope of Services: Feeq Tech Solutions provides services including, but not limited to, web development, digital marketing, and AI Agent services.
  • Service Agreements: The specific terms, scope, deliverables, and fees for any Service will be detailed in a separate formal proposal or Master Service Agreement (“Service Agreement”). In the event of any conflict between these general Terms and a specific Service Agreement, the terms of the Service Agreement will prevail.
  • Client Responsibilities: You agree to provide all necessary information, materials, and timely feedback required for us to perform the Services. Delays on your part may result in adjustments to project timelines and costs.

9. Intellectual Property

  • Our Content: All content on the Site, including text, graphics, logos, images, and software, is the property of Feeq FZE or its content suppliers and is protected by international copyright and other intellectual property laws.
  • Service Deliverables: Ownership of intellectual property for deliverables created as part of our Services will be outlined in the specific Service Agreement for that project.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will Feeq FZE, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site, Products, or Services; (ii) any conduct or content of any third party; (iii) any content obtained; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

11. Indemnification

You agree to defend, indemnify, and hold harmless Feeq FZE and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your use and access of the Site, Products or Services, or a breach of these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates as applicable in the Emirate of Sharjah. Any dispute arising from, or related to, these Terms shall be subject to the exclusive jurisdiction of the courts of Sharjah.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this Site and updating the “Last Updated” date. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
